The appeal the accused filed against the decision to refer his case to the courts in Bosnia and Herzegovina was dismissed. Stankovic will have to be in Sarajevo within 30 days

The Appeals Chamber of the ICTY dismissed the appeal filed by Radovan Stankovic a/k/a Rasa against the decision to refer his case to the courts in Bosnia and Herzegovina. Stankovic is charged, together with Gojko Jankovic and Dragan Zelenovic, with rapes and sexual enslavement of Bosniaks in Foca in 1992. The decision was rendered by the Referral Bench on 17 May 2005. He appealed because he did not want to be tried “by the mujahedin and Ustasha judges" in the "Jamahiriya", as he called Bosnia and Herzegovina.
Dismissing Stankovic's appeal, the Appeals Chamber ordered the Registrar, in a decision made public today, to organize the transfer of the accused to BH within thirty days and the Office of the Prosecutor to forward all the evidence to the State Court in Sarajevo within the same period.
